Terms & Conditions
The terms and conditions referred to, and set out in, this document together with the privacy policy at Annex 1 of this document (“Privacy Policy”) form a legally binding agreement between you and Leeds Building Society. It is important that you take the time to read them carefully. You may from time to time use the services of third parties, which will be subject to separate terms and conditions and privacy policies between you and them. It is important that you also take the time to read those terms and policies carefully.

1. Your relationship with Leeds Building Society

  • 1.1 Your use of the www.saveinteresting.co.uk website together with any participation by you in the make saving interesting campaign (“Campaign”) and any LBS items, channels, software, data feeds and services provided to you on or from or through the SI Website by LBS (the “SI Website”) is subject to the terms of a legal agreement set out within this document (“SI Terms”) between you and LBS. “LBS”, “We” or “Us” means Leeds Building Society. LBS is a member of the Building Societies Association and is authorised by the Prudential Regulation Authority and regulated by the Financial Conduct Authority (“FCA”) and the Prudential Regulation Authority and our registration number is 164992. You can check this on the Financial Services Register by visiting the FCA website at www.fca.org.uk or by contacting the FCA on 0800 111 6768.
  • 1.2 The SI Terms apply to all users of the SI Website, including users who are also contributors of Content to the SI Website. “Content” includes the text, software, scripts, graphics, photos, sounds, music, videos, audiovisual combinations, interactive features and other materials you may view on, access through or contribute to the SI Website, either via the Vimeo Player or by any Provider Services strictly on the terms of the relevant Provider Terms (as defined in clause 2 of these SI Terms) or otherwise.
  • 1.3 We may, acting in our ultimate discretion, and without prior notice to you, (i) upload and / or remove the Content from the SI Website and / or (ii) may stop (permanently or temporarily) providing access to the SI Website (or any features within the SI Website).
  • 1.4 By using the SI Website you confirm that you accept the SI Terms, including, but not limited to, the Privacy Policy at Annex 1 of this document, and that you agree to comply with them and you should print off or save a copy of the SI Terms and the Privacy Policy for your records. If you do not agree to SI Terms and the Privacy Policy, you must not use the SI Website.
  • 1.5 LBS reserve the right, in its absolute discretion, to make changes to the SI Terms from time to time. The modified version of the SI Terms, including, but not limited to, the Privacy Policy at Annex 1 of this document (the “Modified SI Terms”) will be made available on the SI Website from time to time. If you do not agree to the Modified SI Terms you must stop using SI Website. Your continued use of the SI Website after the date the Modified SI Terms are posted on the SI Website will constitute your acceptance of the Modified SI Terms.

2. Your relationship with third parties

  • 2.1 In order to upload and / or view any Content an online video sharing platform / player is provided to you by Vimeo LLC (“Vimeo”) on or from or through (as the case may be) the SI Website (“Vimeo Player”).
  • 2.2 As part of your use of the SI Website, you may use the services of (including, but not limited to, the Vimeo Player), and / or access the websites of, third party providers (“Provider Services”), including, but not limited to Vimeo, Facebook Ireland Limited, Facebook Inc and Twitter Inc (“Providers”).
  • 2.3 Any Provider Services (including, but not limited to the Vimeo Player) shall be governed by the terms and policies issued by the respective Providers from time to time. You should read the terms and conditions, any privacy policies, cookie policies together with any other relevant terms and / or policies issued by the respective Providers (“Provider Terms”) before using any of the Provider Services. Your acceptance together with any changes to any Provider Terms shall be governed by the respective Provider Terms.
  • 2.4 LBS has no control over, and assumes no responsibility for any acts or omissions of any Providers together with any Provider Services and / or the content of any Provider Terms.
  • 2.5 You acknowledge and agree that LBS is not responsible for the availability of any Provider Services and does not endorse any advertising, products or other materials issued or made available as part of any Provider Services.
  • 2.6 You acknowledge and agree that LBS is not liable for any loss or damage which may be incurred by you as a result of the use and / or availability of any Provider Services, or as a result of any reliance placed by you on the completeness, accuracy or existence of any advertising, products or other materials issued and / or made available as part of any Provider Services.
  • 2.7 If there is a conflict or difference between these SI Terms and any Provider Terms, then these SI Terms shall prevail.

3. SI Website users

  • 3.1 In order to access some features of the SI Website, you will be required to supply information to LBS, including, but not limited to your name and contact details and such information must be accurate and complete. LBS shall only process your personal data in accordance with the Data Protection Act 1998 (as amended).
  • 3.2 You must notify LBS immediately of any breach of security or unauthorised use of your information on the SI Website that you become aware of.
  • 3.3 You agree that you will be solely responsible (to LBS, and to others) for all activity that you perform and / or conduct on the SI Website.
  • 3.4 As part of your use of the SI Website, you may from time to time supply information to Providers in relation to any Provider Services or otherwise which will be governed by the relevant Provider Terms.

4. General restrictions on use

  • 4.1 LBS hereby grants you permission to access and use the SI Website, subject to the following conditions, and you agree that your failure to adhere to any of these conditions shall constitute a breach of these SI Terms on your part:
    • A. you agree not to distribute any part of or parts of the SI Website, including but not limited to any Content, in any medium unless LBS makes available the means for such distribution through functionality offered by the SI Website;
    • B. you agree not to alter or modify any part of the SI Website;
    • C. to the extent that you use any Provider Services, that you comply, at all times, with the relevant Provider Terms;
    • D. you agree not to (or attempt to) circumvent, disable or otherwise interfere with any security related features of the SI Website or features that (i) prevent or restrict use or copying of Content or (ii) enforce limitations on use of the SI Website or the content accessible via the SI Website;
    • E. you agree not to use the SI Website for any commercial purpose;
    • F. you agree not to use any automated system (including, without limitation, any robot, spider or offline reader) that accesses the SI Website in a manner that sends more request messages to the SI Website servers in a given period of time than a human can reasonably produce in the same period by using a publicly available, standard (i.e. not modified) web browser;
    • G. you agree not to collect any personal data of any user of the SI Website.
  • 4.2 You agree that you will comply with all of the other provisions of the SI Terms at all times during your use of the SI Website.

5. Eligibility

  • 5.1 The eligibility to participate in the Campaign is strictly subject to the eligibility terms contained within this clause 5.1 (“Eligibility Terms”).
    • A. You must be aged 18 years or over.
    • B. Your entry into the Campaign is obtained by uploading Content onto the SI Website. The Content must:
      • i. not mention any financial information or monetary amounts, including, but not limited to, the amount you are trying to save for the purposes of 5.1 B iii below;
      • ii. be no longer than 3 minutes in duration; and
      • iii. provide a clear description of your saving goal (“Saving Goal”).
    • C. One entry per person only.
    • D. The closing date for receipt of Content is 30 June 2014. Any Content received after this date will not be considered for participation in the Campaign.
    • E. All Content will be reviewed by LBS and any proposed participant(s) shall be chosen by LBS, acting in its absolute discretion, by 30 June 2014. Only the proposed participant(s) chosen by LBS will be notified
    • F. If your Content is chosen by LBS to participant in the Campaign, you will be required to open an LBS Everyday Saver account or an LBS E-Saver account and you will receive an invitation pack from LBS setting out how LBS proposes to assist you together with any financial contributions it proposes to make. If you agree to the invitation and would like to participate in the Campaign you must complete the invitation pack and return this to LBS either, by attending one of LBS’s branches (by appointment only) or by post, by the date specified within the invitation pack. Once agreed to by LBS and you, the terms of the invitation pack, including, but not limited to the Everyday Saver account terms and conditions or the E-Saver account terms and conditions, shall apply in addition to the SI Terms.
    • G. The invitation pack will contain, or refer to, the Everyday Saver account, or the E-Saver account, application forms and the corresponding product terms and conditions shall apply. Before opening the Everyday Saver account or the E-Saver account, we will need to verify your identity and address, details of how we will do this shall be contained within the invitation pack. On the date that the Everyday Saver account or the E-Saver account is opened, LBS shall deposit £100 into the account in respect of the minimum investment required to open the Everyday Saver account or the E-Saver account. This sum shall then belong to you once deposited strictly on the condition that it is used towards meeting your Saving Goal.
    • H. The name(s) of the selected participant(s) will be available on written request after 30 June 2014. Please write to the Marketing Department, Leeds Building Society, 105 Albion Street, Leeds LS1 5AS.
    • I. The Campaign is not open to employees of LBS, their agents or members of their family.
    • J. Any financial contribution by LBS to any participant(s) in relation to the Campaign shall be at LBS’s ultimate discretion, shall be set out within the invitation pack and, in any event, shall not exceed £2,000 (excluding the £100 deposited by LBS in the Everyday Saver account or the E-Saver account) and shall be provided strictly on the basis that such contribution is used towards meeting your Saving Goal.
    • K. By submitting Content, you agree to take part in any publicity. LBS reserves the right to publish information about you, including, but not limited to, your name, your home town, your photograph and your Content in any publicity or publications.
    • L. Entry into the Campaign is only available through the SI Website.
    • M. LBS reserves the right to vary these Eligibility Terms and/or withdraw or vary the Campaign at any time.
    • N. The promoter of the Campaign is LBS.

6. Content

  • 6.1 As a SI Website user you may submit Content. You agree that whether or not Content is published on the SI Website, LBS do not guarantee any confidentiality with respect to Content.
  • 6.2 You retain all of your ownership rights in your Content, but you are required to grant licence rights to LBS and other users of the SI Website. These are described in clause 7 of these SI Terms (Your licence). You are required to grant certain rights to Providers in accordance with their respective Provider Terms and you should review these terms before engaging any Provider Services
  • 6.3 You acknowledge and agree that you are solely responsible for your own Content and the consequences of posting or publishing it. LBS do not endorse any Content or any opinion, recommendation, or advice expressed therein, and LBS expressly disclaim any and all liability in connection with Content.
  • 6.4 You will have (and will continue to have during your use of the SI Website) all necessary licenses, rights, consents, and permissions which are required to enable LBS to use your Content in the manner contemplated by the SI Website and these SI Terms. To the extent that this is not the case you may be liable to pay LBS any losses incurred due to your breach of this clause 6.4.
  • 6.5 You agree that you will not post or upload any Content which contains:
    • A. material which it is unlawful for you to possess in England and / or the country in which you are resident, or which it would be unlawful for LBS to use or possess in connection with the SI Website;
    • B. pornography or sexually explicit content;
    • C. animal abuse, drug abuse or bomb making;
    • D. any form of violence;
    • E. accidents, dead bodies or similar things;
    • F. speech which attacks or demeans a group based on race or ethnic origin, religion, disability, gender, age and / or sexual orientation/gender identity;
  • or is otherwise in breach of any Provider Terms
  • 6.6 You agree that Content you submit to the SI Website will not contain any third party copyright material, or material that is subject to other third party ownership rights (including rights of privacy or rights of publicity), unless you have a formal licence or permission from the rightful owner, or are otherwise legally entitled, to post the material in question and to grant LBS the licence referred to in clause 7 (Your licence) below.
  • 6.7 You further acknowledge and agree that in using the SI Website, you may be exposed to Content that is factually inaccurate, offensive, indecent, or otherwise objectionable to you. You agree to waive, and hereby do waive, any rights or remedies you have or may have against LBS with respect to any such Content.

7. Your licence

  • 7.1 When you upload or post Content to the SI Website, you grant:
    • A. to LBS, a worldwide, non-exclusive, royalty-free, transferable licence (with right to sub-licence) to use, reproduce, distribute, prepare derivative works of, display, and perform that Content in connection with the SI Website and otherwise in connection with LBS’s business, including without limitation for promoting and redistributing part or all of the SI Website (and derivative works thereof) in any media formats and through any media channels and LBS shall not be responsible for any acts or omissions of any third parties in relation to the Content;
    • B. to each user of the SI Website, a worldwide, non-exclusive, royalty-free licence to access your Content through the SI Website, and to use, reproduce, distribute, prepare derivative works of, display and perform such Content to the extent permitted by the functionality of the SI Website and under these SI Terms and each user shall not be responsible for any acts or omissions of any third parties in relation to the Content.
  • 7.2 The above licenses granted by you in the Content continues for 80 years from the date that the Content is posted on the SI Website irrespective of whether you remove or delete your Content from the SI Website., but otherwise your ownerships rights are not affected.
  • 7.3 You will also be required to grant certain licence rights to Providers in accordance with their respective Provider Terms. You should review these terms before engaging any Provider Services.
  • 7.4 With the exception of Content submitted to the SI Website by you, all other Content on the SI Website is either owned by or licensed to LBS.
  • 8. Ending your relationship with the SI Website
  • 8.1 The SI Terms will continue to apply until terminated by either you or LBS as set out below.
  • 8.2 If you want to terminate the SI Terms with LBS, you may do so by no longer using the SI Website.
  • 8.3 LBS may at any time, acting in its absolute discretion, terminate these SI Terms and / or otherwise remove Content in accordance with clause 1.3 of these SI Terms.
  • 8.4 When these SI Terms come to an end, all of the legal rights, obligations and liabilities that you and LBS have benefited from, been subject to (or which have accrued over time whilst the SI Terms have been in force) or which are expressed or implied to continue indefinitely shall remain in full force and effect and the provisions of clause 11.6 shall continue to apply to such rights, obligations and liabilities indefinitely.
  • 9. Exclusion of Warranties
  • 9.1 Nothing in the SI Terms shall affect any statutory rights that you are entitled to as a consumer.
  • 9.2 LBS makes no warranty or representation to you with respect to any Provider, Provider Services, Provider Terms, the SI Website, these SI Terms, any Content or any text, scripts, graphics, photos, sounds, music, videos, audiovisual combinations, and other materials posted by you or any other third party either on the SI Website, on any website owned and / or operated by any Provider or otherwise.
  • 9.3 In particular LBS do not represent or warrant to you that:
    • A. your use of the SI Website or any Provider Services will meet your requirements;
    • B. your use of the SI Website or any Provider Services will be uninterrupted, timely, secure or free from error;
    • C. any information obtained by you as a result of your use of the SI Website or any Provider Services will be accurate or reliable; and
    • D. that defects in the operation or functionality of any software provided to you as part of the SI Website or any Provider Services will be corrected.
  • 9.4 Subject to clause 9.1, no conditions, warranties or other terms (including any implied terms as to satisfactory quality, fitness for purpose or conformance with description) apply to the SI Website except to the extent that they are expressly set out in the SI Terms.
  • 10. Limitation of Liability
  • 10.1 Nothing in these SI Terms shall exclude or limit LBS’s liability for (a) death or personal injury caused by its negligence, or the negligence of its employees, agents or subcontractors; or (b) fraud or fraudulent misrepresentation.
  • 10.2 Subject to the overall provision in clause 10.1 above, LBS shall not be liable to you for:
    • A. any losses incurred by you with respect to your use of any Provider Services, any breach of any Provider Terms or otherwise due to your relationship with any Provider;
    • B. any losses which may be incurred by you not as a direct result of LBS’s acts or omissions;
    • C. any loss or damage which may be incurred by you as a result of:
      • i. any reliance placed by you on the completeness, accuracy or existence of any Content and / or the SI Website;
      • ii. any changes which LBS may make to the SI Website, or for any permanent or temporary break in the provision of the SI Website (or any features within the SI Website);
      • iii. the deletion of, corruption of, or failure to store, any Content and other communications data maintained or transmitted by or through your use of the SI Website;
      • iv. your failure to provide LBS with complete and accurate information;
      • v. your failure to keep your information secure and confidential.
    • 10.3 The limitations on LBS’s liability to you in clause 10.2 above shall apply whether or not LBS has been advised of or should have been aware of the possibility of any such losses arising.
    • 10.4 Subject to clauses 10.1 and 10.2, LBS’s total liability to you in respect of any and all losses arising under or in connection with the SI Terms shall not exceed £1,000 for any single claim and shall not exceed £20,000 for all claims in aggregate.

    11. General legal terms

    • 11.1 The SI Terms constitute the whole legal agreement between you and LBS in relation to the SI Website only. All other terms and / or agreements between you and LBS from time to time, together with any Provider Terms, entered into between you and any Provider in relation to any Providers Services or otherwise, from time to time, are expressly excluded from the SI Terms.
    • 11.2 You agree that LBS may provide you with notices, including those regarding changes to the SI Terms, by postings on the SI Website.
    • 11.3 You agree that if LBS does not exercise or enforce any legal right or remedy which is contained in the SI Terms (or which LBS has the benefit of under any applicable law), this will not be taken to be a formal waiver of LBS’s rights and that those rights or remedies will still be available to LBS.
    • 11.4 If any court of law, having the jurisdiction to decide on this matter, rules that any provision of these SI Terms is invalid, then that provision will be removed from the SI Terms without affecting the rest of the SI Terms. The remaining provisions of the SI Terms will continue to be valid and enforceable.
    • 11.5 Other than the parties to these SI Terms, no other person or company shall be a third party beneficiary of the SI Terms.
    • 11.6 The SI Terms, and your relationship with LBS under the SI Terms, shall be governed by English law. You and LBS agree to submit to the exclusive jurisdiction of the courts of England to resolve any legal matter arising from the SI Terms. Notwithstanding this, you agree that LBS shall still be allowed to apply for injunctive remedies (or other equivalent types of urgent legal remedy) in any jurisdiction.
    • 11.7 You should review any relevant Provider Terms before engaging any Provider Services to establish which jurisdiction governs your relationship with any relevant Provider together with any related terms.

    Annex 1- Privacy Policy

    The SI Website may, from time to time, contain links or may otherwise direct you to, other websites and / or any Provider Services. If you follow a link to any of these websites and / or otherwise use any Provider Services, please note that these websites and / or these Providers Services are subject to their own privacy policies and that LBS do not accept any responsibility or liability for these policies. Please check these policies before you submit any personal data to these websites and / or Providers. LBS is committed to protecting and respecting your privacy. This policy sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it. For the purposes of the Data Protection Act 1998 (the “Act”), the data controller is Leeds Building Society of 105 Albion Street, Leeds LS1 5AS. Our nominated representative for the purpose of the Act is the Head of Legal Services. Questions, comments and requests regarding this Privacy Policy are welcomed and should be addressed to the Marketing Department, Leeds Building Society, 105 Albion Street, Leeds LS1 5AS.

    A1. INFORMATION WE MAY COLLECT FROM YOU
    We may collect and process the following data about you:

    • • Information you give us. You may give us information about you by filling in forms and / or fields on the SI Website or by corresponding with us by phone, e-mail or otherwise. This includes information you provide when you visit the SI Website, apply to participate in the Campaign, participate in any discussion boards or other social media functions on the SI Website, upload any Content and when you report a problem with the SI Website. The information you give us may include your name, address, e-mail address and phone number, together with any Content that you may upload onto the SI Website from time to time.
    • • Information we collect about you. With regard to each of your visits to the SI Website we may automatically collect the following information:
      • o technical information, including the Internet protocol (IP) address used to connect your computer to the Internet, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform;
      • o information about your visit, including the full Uniform Resource Locators (URL) clickstream to, through and from the SI Website (including date and time); page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page and any phone number used to call us.
    • • Information we receive from other sources. We may receive information about you if you use any of the other websites we operate or the other services we provide.

    A2. USES MADE OF THE INFORMATION
    We use information held about you in the following ways:

    • • Information you give to us. We will use this information:
      • o to contact you in relation to the Campaign or otherwise in accordance with these SI Terms;
      • o to carry out our obligations arising from any contracts entered into between you and us;
      • o in accordance with paragraph A5 of this policy (Your Rights);
      • o to notify you about changes to the SI Website;
      • o to ensure that content from the SI Website is presented in the most effective manner for you and for your
        computer.
    • • Information we collect about you. We will use this information:
      • o to administer the SI Website and for internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes;
      • o to improve the SI Website to ensure that content is presented in the most effective manner for you and for your computer;
      • o to allow you to participate in interactive features of the SI Website, when you choose to do so;
      • o as part of our efforts to keep the SI Website safe and secure.
    • • Information we receive from other sources. We may combine this information with information you give to us and information we collect about you. We may use this information and the combined information for the purposes set out within this policy (depending on the types of information we receive).

    A3. DISCLOSURE OF YOUR INFORMATION
    We may disclose your personal information to third parties:

    • • In the event that you are invited to participate in the Campaign or otherwise in accordance with these SI Terms.
    • • If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply the SI Terms and other agreements; or to protect the rights, property, or safety of LBS, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

    A4. SECURITY OF DATA
    Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to the SI Website and therefore any transmission is at your own risk. Once we have received your information, we will use procedures and security features to try to prevent unauthorised access.

    A5. YOUR RIGHTS
    You have the right to ask us not to process your personal data for marketing purposes. We will usually inform you (before collecting your data) if we intend to use your data for such purposes or if we intend to disclose your information to any third party for such purposes. You can also exercise the right at any time by contacting us at the Customer Services Department, Leeds Building Society, 105 Albion Street, Leeds, LS1 5AS. If you take up any product with LBS, including, but not limited to, the Everyday Saver account or the E-Saver account, then separate terms and conditions together with how we may process your personal data, shall apply. You can exercise your right to prevent such processing by checking certain boxes on the forms we use to collect your data at the time you take up any product with us.

    A6. CHANGES TO OUR PRIVACY POLICY
    Any changes we may make to this policy in the future will be posted on the SI Website. Please check back frequently to see any updates or changes to our Privacy Policy.
